Jennifer was recently interviewed by a reporter from Bankrate and asked what are the most important qualities in a fiduciary. As she regularly tells her clients, here is the list:
Honesty —- it can’t be stressed enough;
Detail-oriented;
Can maintain records; and
Knows how, when, and where to get help.
Fulfilling fiduciary responsibilities is an important task, one being done for the benefit of the person creating the estate planning instrument and that person’s other intended beneficiaries. Not everyone, in fact most people, do not have a family member that has all of the characteristics and requisite skill set to do every aspect of the job. At least start by picking someone who is honest and displays good judgment. If that person is also detail oriented enough to not miss deadlines (taxes, payment of debts and liabilities, etc.), and can maintain the appropriate records, he or she can at least hire qualified help to do the rest such as investing, preparing tax returns, advise about legal duties fiduciaries owe, and preparing accountings.
